Accounting and Tax Fraud Investigations
Many of the securities matters described in the Securities Litigation and Enforcement section of our website concern allegations of improper accounting or tax practices. We have represented numerous officials, including CFOs of publicly traded companies, in investigations by federal and state agencies concerning accounting and tax issues. These investigations can proceed under numerous legal theories, including mail or wire fraud, securities fraud or tax offenses.
Examples of our experience in this area include:
- Representation of underwriters and insurance industry executives in state and federal investigations into accounting irregularities in the insurance industry.
-
Representation of officers of public companies in investigations concerning possible violations of U.S. tax laws, involving such matters as revenue recognition, understated and overstated income and improper accounting.
-
Representation of an executive of Enron in an investigation brought by the Enron Task Force.
-
Representation of individuals in investigations by the Department of Justice into promotion of, and/or investment in, certain tax shelters.
