Bank Fraud and Mortgage Fraud
We have represented numerous individuals and corporations under investigation for bank fraud and mortgage fraud. Federal and state agencies are particularly aggressive in these areas because of federal involvement in the banking and mortgage industries through the FDIC and FHA and GSE (Fannie Mae and Freddie Mac) loan programs. In particular, an extended period of low interest rates combined with a government emphasis on home ownership has led to a proliferation of FHA and GSE loans, and a corresponding increase in investigations by federal and states agencies.
Examples of our experience in these areas include:
- Representation of the chairman and chief operating officer of a commercial bank in an investigation by a United States Attorney’s Office concerning allegations of bank and mortgage fraud.
- Representation of a major real estate developer in a Department of Justice investigation concerning allegations of political corruption and mortgage fraud.
- Representation of a mortgage broker in an investigation by a United States Attorney’s Office concerning allegations of mortgage fraud.
- Representation of an employee of a major global financial services firm in an investigation by a United States Attorney’s Office concerning allegations of fraud in the sale of auction rate securities backed by subprime mortgages.
- Representation of the operations manager of a retail brokerage firm in an investigation by a United States Attorney’s Office concerning fraud in the procurement of a Small Business Administration (SBA) loan.
